THIS MATTER came before the undersigned United States Magistrate Judge on January 17, 2003 on Plaintiffs Motion for Summary Judgment [# 15]. The parties have consented to the jurisdiction of a Magistrate Judge pursuant to 28 U.S.C. § 636(c) and Fed.R.Civ.P. 73[# 28]. For the reasons which follow, the Plaintiffs Motion is granted in part.
