Appellant Adan Ares challenges the district court's determination, upon granting defendant's motion for summary judgment, that Ares was an exempt agricultural employee under the Fair Labor Standards Act, 29 U.S.C. § 213(b)(12), and therefore not entitled to claim overtime wages.1 This Court exercises jurisdiction over this appeal under 28 U.S.C § 1291.
