MEMORANDUM OPINION AND ORDER

SHADUR, Senior District Judge.

Jimmy Santiago ("Santiago") is serving consecutive state court sentences of 70 years for first degree murder and 30 years for attempted first degree murder in a case that was indicted just over a decade ago. On December 15, 2003 his effort to obtain federal habeas relief—a Petition for Writ of Habeas Corpus ("Petition") brought under 28 U.S.C. § 22541
