¶ 1 The lower court granted defendants' demurrer and dismissed plaintiff's complaint with prejudice. To determine whether plaintiff's complaint "is clearly insufficient to establish [his] right to relief," this Court must assume as true "all well-pleaded, material, relevant facts... and every inference fairly deducible from those facts."
