After being indicted for numerous crimes in Fulton County, including two murders, Derrick Agee moved to dismiss the indictments, contending that his pretrial incarceration (i) constituted punishment and double jeopardy prevented further prosecution and (ii) was the result of prosecutorial misconduct.
