After a jury trial, William David Smith was convicted of cruelty to children and sentenced to ten years to serve in confinement and ten years on probation. On appeal, Smith argues that the trial court erred when it denied his motion for directed verdict and failed to give his request to charge the jury on the lesser included offense of simple battery. We affirm.
