This matter is before the Court on several motions for summary judgment. For the reasons set forth below, Wernsing's Motion for Partial Summary Judgment [# 36] is GRANTED. Bingaman1 and Cannon's Motion for Partial Summary Judgment [# 41] is GRANTED, and Defendants' Motion for Summary Judgment [# 43] is GRANTED IN PART and DENIED IN PART.
