No. 02-3970.

351 F.3d 897 (2003)

UNITED STATES of America, Appellee, v. George GUTIERREZ, Appellant.

United States Court of Appeals, Eighth Circuit.

Filed: December 18, 2003.

Attorney(s) appearing for the Case

Virginia G. Villa, argued, Assistant Federal Defender, of Minneapolis, MN, for appellant.

James E. Lackner, argued, Assistant U.S. Attorney, of Minneapolis, MN (Thomas B. Heffelfinger, on the brief), for appellee.

Before MORRIS SHEPPARD ARNOLD, HANSEN and SMITH, Circuit Judges.

SMITH, Circuit Judge.

George Anthony Gutierrez seeks a new trial. Gutierrez, who represented himself below, contends that he should have been granted a new trial because the actions of his standby counsel deprived him of his right to self-representation. Gutierrez also alleges the district court1 committed several evidentiary errors which—when considered in aggregate—deprived him of a fair trial.2
