This case was originally brought in federal district court in the Eastern District of Missouri (hereinafter "the Missouri district court"). That court dismissed the case for improper venue. Appellants, Mike's Inc. and Mike's Marine, Inc., then requested that the court, instead of dismissing the suit, transfer it to the proper venue to avoid statute of limitations problems that might arise from dismissal.
