PROCEDURAL HISTORY AND FACTS

¶ 1. In the early morning hours of February 25, 2000, Officers Tim Gandy and Patrick Ervin of the Scott County Sheriff's Department were on patrol when they stopped by a Chevron Service Station in Forest.
