I.

In fiscal year 2001, courts granted downward departures based on the defendant's substantial assistance to the government in 17.1% of all federal criminal cases. United States Sentencing Commission, 2001 Sourcebook of Federal Sentencing Statistics 53 (2001). In drug trafficking cases, the rate was even higher—26.3%—compared to just 10.5% in all other cases.1
