Plaintiffs filed a three-count complaint against Bristol-Myers Squibb Co. ("Bristol-Myers"), alleging violations of federal and state antitrust laws. Bristol-Myers moves to dismiss Plaintiffs' complaint under Federal Rule of Civil Procedure 12(b)(6). Bristol-Myers argues that (1) Plaintiffs suffered no antitrust injury and (2) Plaintiffs' claims are time-barred. The Court agrees with the latter...
