JOHNSON v. STATE

No. 1D02-2841.

852 So.2d 351 (2003)

Kristy JOHNSON, Appellant, v. STATE of Florida, Commission on Ethics, Appellee.

District Court of Appeal of Florida, First District.

August 14, 2003.

Attorney(s) appearing for the Case

Peter D. Ostreich, Staff Attorney, and Philip C. Claypool, General Counsel, Commission on Ethics, Tallahassee, for Appellee.

PER CURIAM.

We decline to reach the merits of Kristy Johnson's appeal from an advisory opinion of the Florida Commission on Ethics, because we conclude that her challenge, based upon application of the two-year representation bar of section 112.313(9)(a)4, Florida Statutes (2001), is now moot. Without prejudice to Johnson's right to appeal later from an order of the Commission upon an adequate showing of injury, we DISMISS this appeal as moot.
