189 Or. App. 235

STATE of Oregon, Respondent, v. Joe Seth Trevor McBEAN # 1, Appellant.

Court of Appeals of Oregon.

Decided August 13, 2003.

Attorney(s) appearing for the Case

Rebecca Duncan, Deputy Public Defender, argued the cause for appellant. With her on the brief was David Groom, Acting Executive Director, Office of Public Defense Services.

Douglas F. Zier, Assistant Attorney General, argued the cause for respondent. With him on the brief were Hardy Myers, Attorney General, and Mary H. Williams, Solicitor General.

Before EDMONDS, Presiding Judge, and KISTLER and SCHUMAN, Judges.

SCHUMAN, J.

Defendant was convicted of reckless burning, ORS 164.335, and appeals, contending that there was insufficient evidence to establish his guilt. We review the sufficiency of the evidence to support a conviction to determine whether "any rational trier of fact could have found the essential elements of the crime beyond a reasonable doubt."
