No. 02CA0640.

101 P.3d 1098 (2003)

The PEOPLE of the State of Colorado, Plaintiff-Appellee, v. Christopher McMURTRY, Defendant-Appellant.

Colorado Court of Appeals, Div. II.

Rehearing Denied June 17, 2004.

Certiorari Granted November 22, 2004.

Attorney(s) appearing for the Case

Ken Salazar, Attorney General, Jennifer M. Smith, Assistant Attorney General, Denver, Colorado, for Plaintiff-Appellee.

David S. Kaplan, Colorado State Public Defender, Mark G. Walta, Deputy State Public Defender, Denver, Colorado, for Defendant-Appellant.

Defendant, Christopher McMurtry, appeals the judgment of conviction entered pursuant to his plea of guilty to attempted sexual assault. At issue in this case is whether defendant's constitutional or statutory speedy trial rights were violated, thus depriving the trial court of jurisdiction to accept his guilty plea. Because we conclude his rights were not violated and the trial court did not lack jurisdiction, we affirm.
