Sherman & Hemstreet, Inc. (Sherman) sued its insurer, Cincinnati Insurance Company (Cincinnati), because the insurer would pay only a portion of its claim. Based upon a joint statement of undisputed material facts, the parties filed cross-motions for summary judgment.
