KATZ, District Judge.

Pending before this Court is Defendant's Motion to Dismiss and/or Motion to Stay Proceedings (Doc. No. 3). For the following reasons, the Court will deny Defendant's motion.

I. BACKGROUND

In April 2001 Defendant Carl Olmstead was involved in an automobile accident in which he was struck by another vehicle. At the time of the accident, Olmstead was employed by Sauder Woodworking
