Bulk Petroleum Corporation ("Bulk") operated a gas station on a parcel of property adjacent to land owned by JMS Development Company ("JMS"). The operations of the gas station polluted both pieces of property. JMS filed this suit, seeking relief for the contamination under the federal Resource Conservation and Recovery Act, 42 U.S.C. § 6972 ("RCRA"), as well as Illinois law.
