Defendant Anthony Witherspoon appeals as of right his conviction and sentence for second-degree criminal sexual conduct, M.C.L. § 750.520(c)(1)(a). The circuit court sentenced defendant as a fourth-offense habitual offender, M.C.L. § 769.12, to eight to twenty years in prison for the conviction, which involved a sexual assault against a nine-year-old girl.
