On August 31, 2001, Defendants Unum Life Insurance Company of America ("Unum") and Boncosky Transportation Services, Inc. ("Boncosky") filed a motion to dismiss Plaintiff Thomas Adams's action for declaratory judgment, breach of contract, bad faith, and punitive damages (Doc. 10). As grounds for its request to dismiss this action, defendants say Adams's action is preempted by the Employee Retirement Security Income Act of 1974...
