Before the Court are the parties1 cross-motions for summary judgment. Pursuant to Local Rule 7.1(e)(2), the Court will determine these motions without a hearing. For the reasons set forth below, the Court shall deny Plaintiff's motion [docket entry 15] and grant Defendant's motion [docket entry 14].
