I. INTRODUCTION

This matter is before the Court on Plaintiff's Motion for Summary Judgment, and Defendants' Motion for Summary Judgment. Both motions have been fully briefed. The Court heard oral arguments on the issues presented on October 29, 2002, at the Federal Building and U.S. Courthouse in Port Huron, Michigan.
