I. FACTUAL AND PROCEDURAL BACKGROUND

On May 22, 1997, a jury convicted Jamel R. Rivera ["Rivera" or "appellant"] of assault in the first degree in violation of V.I.CODE ANN. tit. 14, § 295(1). The Territorial Court sentenced Rivera to eight years incarceration with credit for time served to be followed by two years supervised probation. Rivera challenged both his conviction and sentence.
