On March 5, 2001, Tina Aaron Keith pleaded guilty as charged to DWI—third offense, a violation of La. R.S. 14:98(D). On October 26, 2000, when the defendant committed this offense, DWI-third offense was punishable by imprisonment at hard labor for not less than one year nor more than five years, at least six months of which "shall be" without benefits, together with a mandatory fine of $2000, with the court being required to order that the vehicle...
