OPINION

PRICE, J., delivered the opinion of the unanimous Court.

In August 1989, a Pecos County jury found the appellant guilty of capital murder and answered the punishment issues in a manner requiring the imposition of the death penalty. We reversed the conviction. Smith v. State, No. 71, 010 (Tex. Crim.App. December 4, 1991) (not designated for publication). The appellant was again convicted of capital murder and received the death penalty...
