Pedro Balbosa was indicted on two counts of aggravated assault and one count of making terroristic threats. He was tried by a judge without a jury, found guilty on all counts, and sentenced to 15 years in prison. The only reference to his waiver of his right to a jury trial came at the outset of the bench trial when the judge said: "It is my understanding from a previous announcement that the defendant waives his right to a trial by jury and agrees...
