On October 14, 1998, the defendant, a thirty-six year old homeless man, had an altercation with the victim, Paul Peterson, over an abandoned railroad shed in Hyannis. Their argument, warmed by vodka, burst into violence. While the defendant's female companion, Ruth McHenry, looked on, the two combatants, armed with knives, fought one another.
