On September 16, 1998, Defendant-Appellant Peter Moses (Moses) was charged by indictment with the following offenses:

Count I, Attempted Murder in the First Degree of Earl Haskell in violation of Hawaii Revised Statutes (HRS) §§ 705-500 (1993),1 707-701(1)(b) (1993),2 and 706-656 (1993 & Supp.2001)
