This matter is before the court pursuant to the August 13, 2002, Order of this court (Doc. # 13) directing the Defendants to show cause why this case should not be remanded to the Circuit Court of Montgomery County, Alabama, for the same reasons discussed in this court's Memorandum Opinion in Retirement Systems of Alabama v. Merrill Lynch & Co. et al., 209 F.Supp.2d 1257
