Appellant was charged by indictment with the offense of burglary of a habitation with the intent to commit and actually committing sexual assault. Tex. Pen.Code Ann. § 30.02(a)(1), (3) (Vernon Supp.2002). The indictment alleged a prior felony conviction for the purposes of enhancing the range of punishment.
