We deny appellant's motion for rehearing, withdraw our opinion and judgment dated May 23, 2002, and substitute this opinion in its stead.

Appellant, Peary Perry, sued appellee, George Greanias, former City of Houston Controller, alleging libel, slander, intentional infliction of emotional distress, and violations of his constitutional due process and free speech rights.1
