Ordered that the judgment is modified, on the law, by deleting the provision thereof awarding prejudgment interest in the amount of $35,000 for the period of January 1, 1997, through June 30, 2001, and substituting therefor a provision awarding prejudgment interest at the rate of 9% per annum for the same period; as so modified, the judgment is affirmed insofar as appealed and cross-appealed...
