IRELAND, J.

In 1991, the defendant was arraigned and pleaded not guilty to charges of rape, assault and battery by means of a dangerous weapon, and two counts of armed robbery. The Commonwealth nol prossed all the charges, however, stating only, "It is in the interests of justice at this time" to do so. Five years later, the defendant pleaded guilty to charges of rape and breaking and entering in the nighttime with intent...
