The Commonwealth appealed from an order allowing the defendant's motion to suppress evidence obtained during a patfrisk conducted after he was ordered out of a vehicle during a routine traffic stop. In an unpublished memorandum and order pursuant to its rule 1:28, the Appeals Court affirmed the suppression order, concluding that there was no basis for ordering the defendant out of the car.
