Ordered that the order is reversed insofar as appealed from, on the law, without costs or disbursements, the motion, in effect, to confirm that portion of the Referee's report which recommended that all surplus money be distributed to the defendant Roger Horoshko or his assignees is granted, and the matter is remitted to the Supreme Court, Richmond County, for distribution of the surplus money in accordance herewith.
