Stephen Lee Kirkland was convicted of driving under the influence of alcohol ("DUI") by having an alcohol concentration of 0.10 grams or more, OCGA § 40-6-391(a)(5), and of exceeding the maximum posted speed limit, OCGA § 40-6-181. He was acquitted of DUI to the extent that he was a less safe driver, OCGA § 40-6-391(a)(1). He was sentenced to twelve months on probation with the first thirty days to be served in work release, eighty hours...
