Defendant Mitchell David Holmes was indicted on 15 February 1999 for the first-degree murder of Dean Ray Creech, the attempted first-degree murder of Ronnie Lynn Hardison, and robbery with a dangerous weapon. Defendant was tried capitally and found guilty of first-degree murder on the basis of premeditation and deliberation and under the felony murder rule.
