This is an action for legal malpractice against plaintiff's attorneys, who allegedly failed to pursue an underlying medical malpractice action in a timely fashion. In order to prevail in a legal malpractice suit, the client must prove that her attorneys were negligent, and that she would have prevailed and recovered a judgment but for that negligence (Larson v Crucet, 105 A.D.2d 651).
