The defendant, Arthur J. Beland, was charged in an indictment with the crime of murder in the first degree, resulting from the beating death of Mary Ann Soares. A jury convicted him of murder in the first degree by reason of extreme atrocity or cruelty. He appeals from his conviction asserting several errors: (1) his statements to police should have been suppressed because his waiver of his Miranda rights was not valid and his statements not voluntary...
