Defendant Jim Pogats, deputy warden of the State Prison of Southern Michigan, appeals by leave granted from a judgment for plaintiffs Willie Thomas, Larry Reid, Edward Grant, and Emma Perrymon, as personal representatives of the estate of Phillip J. Miller. We reverse and remand for entry of judgment in favor of defendant.
