This case arises from injuries sustained by Mr. Phillip Lumpkins ("Lumpkins") during a construction accident occurring on the grounds of the National Institutes of Health ("NIH") in Bethesda, Maryland. Mr. Lumpkins and his wife have filed suit against, inter alia, Hill International, Inc. ("Hill") on theories of negligence and loss of consortium.
