MEMORANDUM OF DECISION ON ORDER FOR RELIEF ON INVOLUNTARY PETITION

On September 21, 2001, petitioning creditor, Frank Simon, commenced this involuntary chapter 7 case against the alleged debtor, Gershon Navon. On October 26 2001, Navon filed an amended answer denying that an involuntary petition could be commenced against him and asserting an affirmative defense and a counterclaim. See 11 U.S.C. § 303(d).
