Opinion by Chief Justice MORRISS.

Latoya Green pled guilty to the offense of possession of marihuana in an amount less than 2,000 pounds, but more than fifty pounds. The jury assessed punishment at five years' imprisonment and a fine of $3,000.00. Pursuant to the jury's recommendation, the court suspended the sentence and set Green's community supervision at ten years.
