Marcon Capital Corp. ("Marcon") sued Robert Gorman ("Gorman") in Vermont state court alleging breach of a financing agreement and received an attachment on Gorman's real property. Subsequently Gorman filed for bankruptcy and brought suit against Marcon and Todd Enright ("Enright"), one of its principals, claiming breach of contract, fraud, negligence in lending, intentional infliction of emotional distress...
