I. FACTS

This case arose from a fatal car wreck that occurred in Estill County on April 9, 1996. Daniel Earl White (White) was killed when a trailer came loose from Rondle Lee's truck, crossed into White's lane, and collided with his truck. Lee was an underinsured motorist for purposes of the Kentucky Motor Vehicle Reparations Act and held only $25,000 in liability insurance. White held an insurance...
