Thomas Mills was indicted for stalking, G. L. c. 265, § 43; assault and battery by means of a dangerous weapon (a shod foot), G. L. c. 265, § 15A; and being a habitual offender, G. L. c. 279, § 25. The first two charges were tried to a jury which, on the stalking charge, found him guilty of the lesser included offense of violation of an abuse prevention order. The jury also found him guilty...
