On February 15, 2002, an arbitration panel of the National Association of Securities Dealers ("NASD") issued an arbitral award (the "Award") denying all claims brought by claimant Suzanne Raiola ("Raiola") against respondent Union Bank of Switzerland, LLC ("UBS").
