On June 21, 2001, Winter Storm Shipping, Ltd. ("Winter Storm") applied ex parte for an order of maritime attachment pursuant to the Federal Arbitration Act, 9 U.S.C. § 8 ("FAA"), and Rule B(1) of the Supplemental Rules for Certain Admiralty and Maritime Claims ("Rule B" or "Rule B(1)").
