FACTUAL/PROCEDURAL BACKGROUND

Petitioner was originally indicted in 1975 for burglary, two counts of armed robbery, assault and battery with intent to kill, and the use of a motor vehicle without the owner's consent. All the indictments, except the burglary indictment, were nol prossed
