OPINION

HERVEY, J., delivered the opinion of the Court in which MEYERS, PRICE, HOLCOMB and COCHRAN, JJ., joined.

This is an appeal from the convicting court's denial of appellant's motion for DNA testing pursuant to Chapter 64 of the Texas Code of Criminal Procedure. We affirm.
